But that's the problem. China barely has rule of law, otherwise this person would have been sentenced according to the law in the first place. But the laws are too broad, weakly implemented and arbitrarily followed.

If anything, most foreigners would hope China starts to follow it's own laws, starting from the so-called constitution.

Take almost any man made environmental disaster for example. Those who criticize ongoing malpractises are put to jail for stirring up trouble, and only after accidents happen, the authrotiies start to look for villains. And even then, without public outcry and social media attention that would not be allowed on news.

This case is similar. Without the current frictions in international relations, the person would not have be retrialed and we would not be having this discussion.

China is soft-skinned and sensitive to foreign criticism, so it gives foreigners special treatment, and only if international relations make it seemingly necessary, they either start following their own laws, or in other cases start ignoring them completely.
