It’s not often that we write about a decision out of a Native American nation; they just don’t pass onto our radar screen very often.

But a Reuters story Wednesday alerted us to a strange and fascinating decision from the Supreme Court of the Cherokee nation, the second-largest Indian tribe in the country.

On Monday, the court gave its thumbs up on a tribal decision from 2007 to oust thousands of descendants of black slaves who were brought to Oklahoma some 170 years ago by Native American owners.

Understanding the case requires flipping back through the history books to the Andrew Jackson administration. (For those who failed their 11th grade U.S. history class, he’s the guy on the $20 bill who looks like Peter Gammons.)

In the 1830s, the Cherokee nation was driven from the east coast to what later became Oklahoma via the “Trail of Tears.” Some Cherokees who had owned land in the South brought their slaves.

After the Civil War, the Cherokee nation voted to admit the slave descendants to the tribe.

But on Monday, the Cherokee nation Supreme Court ruled that a 2007 tribal decision to kick the so-called “Freedmen” out of the tribe was proper. Removal means the so-called “Freedmen” will no longer be eligible for Cherokee nation benefits, like free health care and education.

According to Reuters, there are about 2,800 Freedmen, but there could be as many as 25,000 eligible to enter the tribe.

“This is racism and apartheid in the 21st Century,” said Marilyn Vann, the leader of the Freedmen and the plaintiff in the case.

Spokesmen for the tribe did not respond when asked to comment by Reuters.

The Trail of Tears

~~~~~~  Cherokee / The trail of Tears / Freeman ~~~~~~~~~~
Cherokees were forced out of Eastern/Atlantic part of U.S.Territories after completion of establishment of
the new colony there. In total less than 5% of Cherokee population survived after repeated clash with
White establishment.
The surviving Cherokees were promised with a land in Oklahama Territories, but not long after they arrived,
that promise too, along with many others before and after this, was broken, and the State was taken away
from Native tribes in Ninteen century.
   ( 3000 Black members of Cherokee  in question were receiving dual benefits from Cherokees Nation,
as well as from U.S government , and this amount to dismembership from the tribe eventually.)
   Remember, Cherokees, along with other remaining native tribes have been forced to give up
abundant wealth of the vass land and resources ~
[Today, $1.5 billion a day of oil flowing out of their land, from Oklahoma Texas to Gulf of Mexico;
yes, thats oil alone] for five centuries and counting, my friend. And yet native people of all tribes in America do not bene
fit from anything coming out of their lost continent / receive next to nothing, and are forced to earn their
revenue from setting up casinos and sale of tobacco.
(Little known fact: Do you know that U.S receive a staggering 65% of her massive oil needs domestically,
from mainland & Alaska).
Truth Hurts.
Not many could stand the Truth.
It takes an Enlightened One to know the Truth.
It takes a Brave and Enlightened One to stand up for the Truth.
