6.3 租金支付方式:

6.3.1 Except for the initial monthly basic rent to be paid on the commencement day for rent, Sublessee shall prepay the basic rent for that month before the 10th day of each month; in case that that day falls in the PRC statutory holidays, the payment day shall be postponed accordingly to the first working day thereafter. In case of inconsistency of calculation criteria of basic rent for that month, the basic rent for that month shall be paid in proportion according to actual lease days under corresponding criteria.

除第一个月的基本租金在起租之日交纳外,转租承租人应在每月的第十(10)日之前交纳当月的基本租金;如果该日恰为中国法定节假日,则租金交纳的日期可延至该日之后的第一个营业日。为避免计算方式不一致,该月的基本租金应依照相关公式,根据该月的实际租赁天数,按比例计算。

有关租金计算的公式就是这段:

6.1   Both parties agree that the monthly basic rent within the lease term shall be calculated according to the Subleased Premises (monthly basic rent = basic rent for unit area (m²) × subleased area) described as below:

basic rent is RMB [      ] yuan/month;


这篇合同写的挺差劲的,我只能把这段的顺序调整了一下,翻成了这样:

双方同意,转租期限内,转租物业的月基本租金按以下公式计算:
月基本租金 = 单位面积(m²)月基本租金 × 转租面积;
单位面积(m²)月基本租金为:人民币[]元/月。

inconsistency of calculation criteria 主要是针对某一个月之内,所租用面积有所变更的情况,比如某一个月当中的首十天租了300平方米之后,当月余下的二十天租用了380平方米。在这情况之下,6.1条款的计算方式就需要调整,单价没有变更,但当月中的转租面积在当月中有变。

谢谢hwgr01,但我怎么觉得这里指的是一个月里租赁的日子不足月的情况呢?总归就是合同写的太烂了。光是那个that day falls in the PRC statutory holidays就肯定是错的。

除第一个月的基本租金在起租之日交纳外,转租承租人应在每月的第十(10)日之前提前交纳当月的基本租金;如果该日恰为中国法定节假日,则租金交纳的日期可延至该日之后的第一个营业日。如果某个月的实际租期不满一个月,则该月的基本租金应根据相关公式,按实际租赁的天数,按比例计算。
