A lawyer shared an interseting case during a symposium on surrogacy in Zhejiang province.

The man has a mistress, about 40 years old. He persuaded her to be the surrogate mother. But his mistress is also no longer young, so the man worried about the quality of her ovum. As a result he found a female college student through an intermediary, the student offered her ovum and the man fuse it with his own sperm. the zygote was put into the mistress's uterus.
Later the mistress gave birth to a boy. After weaned, the man took the baby home. Then the mistress became frantic about what he did. She thought she should be the mother of the baby and the man had no right to take her baby away.
They both consulted with lawyers but the lawyers thought it cannot make a case.

The surrogacy is not yet legal in China. And the way the man found the ovum donor is fishy. So this a illegal birth at the first place.

I belive the mistress just want to kick the wife off by  the baby , unfortunately she was disappointed , It seemd the man has tight ties to his  legal wife . so, It's a game , play with tri-part , and the mistress  is underdog .
I know in today's China ,  people prone to blame the mistress try to interfere the family . but it's only base on ethic level , the life nature rights of an innocent baby should be protected essentially and initially. so if I were the judge , I would put all benifit on the baby and punish every adult in this case .
