If they were both Private investigators then its hard to believe they didn't know it was against the law.
If I was on that jury ( Does chinese courts have those ) ? I would have voted for a conviction.
Weather people are a citizen or not, if they break the law, punishment must follow.
In the punishment, it should be taken into account how egergious or blanant the crime is.
There is such a thing as doing something without knowing. But in this case, I find it very hard to believe they didn't.

Foreigners in china are very well behaved compared to western countries who are now over crowded with foreigners either looking for a free dinner tickets for their famliles, or are involved in some criminal activities. The problem for foreigners in china is if one of them breaks the law, you can guarantee to be reading about it on the front page of one of the newspapers. Apart from the british couple caught spying, and the unfortunate british guy who got murdered a few yrs ago, can anyone remember any stories about foreigners breaking any laws in China? (except African drug dealers of course)....lol..
if you want something in life get off your backside, and do it yourself!! don't rely on others to do it for you
